1. Introduction

Welcome to CaribForge ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of our 3D printing services and products for marine applications, accessible via WhatsApp, our website, and in-person transactions in St. Vincent and the Grenadines.

By placing an order or using our services, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Applicable Law

These Terms are governed by the laws of St. Vincent and the Grenadines, including:

  • Consumer Protection Act, 2020 – Ensuring fair trade practices and consumer rights
  • Fair Trading Act, 2008 – Prohibiting unfair and deceptive business practices
  • Electronic Transactions Act – Governing electronic contracts and digital agreements
  • Privacy Act, 2003 – Regulating the collection and use of personal information

As a member of CARICOM, transactions may also be subject to regional consumer protection standards under the Revised Treaty of Chaguaramas.


3. Products and Services

3.1 What We Offer

We manufacture custom and catalog 3D-printed marine parts, including:

  • Rod holders
  • Cup holders
  • Cleats
  • Drain plugs
  • Phone mounts
  • Bait trays

3.2 Materials

Our parts are manufactured using marine-grade materials:

  • PETG – Saltwater and chemical resistant
  • ASA – UV resistant for outdoor use
  • Nylon – High strength applications

3.3 Custom Orders

Custom parts require approval of specifications before production. We reserve the right to decline custom orders that are not technically feasible or appropriate for our manufacturing process.


4. Ordering Process

4.1 How to Order

Orders may be placed via:

  • WhatsApp – Interactive survey and direct messaging
  • Website – Online order form
  • In-Person – At designated pickup locations

4.2 Order Confirmation

An order is confirmed when:

  1. You receive a quote with itemized pricing
  2. You confirm acceptance of the quote
  3. Payment is received (or cash-on-delivery is arranged)

4.3 Pricing

  • All prices are quoted in Eastern Caribbean Dollars (EC$) unless otherwise stated
  • Online payments are processed in US Dollars (USD) at the prevailing exchange rate (approximately EC$2.70 = US$1.00)
  • Prices include manufacturing costs; delivery fees are additional where applicable

4.4 Payment Methods

  • Online: Credit/debit card via Stripe (secure payment processing)
  • Cash: EC$ cash accepted at pickup locations
  • Payment Links: Sent via WhatsApp for convenient mobile payment

5. Delivery and Pickup

5.1 Pickup Locations

Orders may be collected at designated locations in Kingstown and other locations as arranged. You will receive a pickup code via WhatsApp when your order is ready.

5.2 Delivery

Delivery is available to locations within St. Vincent and the Grenadines. Delivery fees vary by destination.

5.3 Production Time

  • Standard Orders: Same-day to 24 hours for catalog items
  • Custom Orders: 2-5 business days depending on complexity
  • Rush Orders: Available for an additional fee

5.4 Risk of Loss

Risk of loss transfers to you upon collection at pickup location or delivery to your specified address.


6. Your Rights Under Consumer Protection Law

Under the Consumer Protection Act, 2020 and Fair Trading Act, 2008, you have the right to:

6.1 Clear Information

  • Accurate descriptions of products and services
  • Transparent pricing with no hidden fees
  • Clear terms and conditions before purchase

6.2 Quality Goods

  • Products that match their description
  • Products that are fit for their intended purpose
  • Products free from defects in materials and workmanship

6.3 Redress

  • The right to a remedy if products are defective or not as described
  • The right to file a complaint with the Fair Trading Commission

7. Warranty

7.1 Warranty Period

All CaribForge products are covered by a 90-day limited warranty from the date of delivery or pickup.

7.2 What Is Covered

  • Defects in materials
  • Manufacturing defects
  • Premature breakage under normal use

7.3 What Is NOT Covered

  • Damage from misuse, abuse, or modification
  • Normal wear and tear
  • Damage from improper installation
  • Damage from exposure to conditions beyond product specifications
  • Lost or stolen items

7.4 Warranty Claims

To make a warranty claim:

  1. Contact us via WhatsApp with your order number
  2. Provide photos of the defective part
  3. Describe the issue and how it occurred

If your claim is approved, we will repair or replace the part at no additional cost.


8. Limitation of Liability

8.1 Maximum Liability

Our maximum liability for any claim arising from your order shall not exceed the amount you paid for that order.

8.2 Exclusions

To the maximum extent permitted by law, we are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Damage to vessels or other property beyond the defective product
  • Personal injury arising from product misuse

Note: Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud or gross negligence.


9. Privacy and Data Protection

Your privacy is important to us. Please see our Privacy Policy for details on how we collect, use, and protect your personal information in accordance with the Privacy Act, 2003.


10. Dispute Resolution

10.1 Informal Resolution

We encourage you to contact us first to resolve any disputes. Most issues can be resolved quickly via WhatsApp.

10.2 Regulatory Complaints

You may file a complaint with the Fair Trading Commission of St. Vincent and the Grenadines regarding unfair trading practices.

10.3 Governing Law

These Terms are governed by the laws of St. Vincent and the Grenadines. Any legal proceedings shall be conducted in the courts of St. Vincent and the Grenadines.


11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on our website and communicated via WhatsApp to active customers. Continued use of our services after changes constitutes acceptance of the updated Terms.
